Which services offered by the property agent are you using?
There are various ways for you to be in in contact with the property agent.

For houses:
You want to sell or let your house and have given instructions to the property agent:

You want to buy or rent a house and have given instructions to the property agent:
• You want to buy a house. See 3.
• You want to rent a house. See 4.

If you are looking for a house and you have not given instructions to the property agent for this purpose, the following situations are possible:
• You want to be kept informed of the properties listed via the property agent without obligation. See 8.
• You want to view an owner-occupied or rented house that is listed via the property agent. See 5.
• You want to buy a house that is listed via the property agent. See 6.
• You want to rent a house that is listed via the property agent. See 7.

View, change or delete data
If you want to know what data the property agent has on you, please send your request by letter or e-mail to info@statigwonen.nl.
You can also send a reasoned letter or e-mail to info@statigwonen.nl if you want to change or delete the data. Your request will be granted as soon as possible, unless the data must be retained by law or there are (other) compelling reasons why the data cannot be changed or deleted.

How long does the property agent retain the data?
The property agent does not retain the data longer than necessary. However, the property agent retains some data for a long period of time:
• Some data pertaining to the services provided are retained by the property agent for 20 years, as during this period the property agent may be held liable for professional errors.
• Any documentation proving that the property agent carried out the obligatory check in the context of the Money Laundering and Terrorist Financing (Prevention) Act (Wwft) must be kept by the property agent for 5 years.

1. You are selling your house and you have given instructions to the property agent for this purpose
The purpose of this contact is to promote your house on your instructions, to gain insight into the value of and interest in your house, to arrange viewings, to negotiate on your behalf and to supervise the transaction. In doing so, the property agent will also verify your identity. The following data may be processed:

The date of registration of the house and the period the house is or has been for sale. a 20 years

If agreed with the property agent, the above information will be published on Funda, other housing websites and on the property agent’s website. This is done to promote your house and the information will be shown there up to 1 year after the transaction. a, d 20 years

2. You are letting your house and you have given instructions to the property agent for this purpose
The purpose of this contact is to promote your house on your instructions, to arrange viewings, to gain insight into the reliability of a potential tenant and to draw up a tenancy agreement. In doing so, the property agent will also verify your identity. The following data may be processed:

The purpose of this contact is to find a suitable home for you on your instructions, to conduct negotiations on your behalf and to supervise the transaction. In doing so, the property agent will also verify your identity. The following data may be processed:

During this contact, the property agent makes viewing appointments, gives you a good impression of the house or business premises and records your opinion of the property. The following data may be processed:

For this contact, the property agent is in contact with you and possibly your property agent in connection with the bidding process. The property agent then carries out the preparatory activities for the purchase agreement and transfer of ownership. During this contact, the property agent also verifies your identity. The following data may be processed:

The purpose of this contact is to establish whether you meet the landlord’s requirements and to prepare the tenancy agreement on the landlord’s behalf. The following data may be processed:

The purpose of this contact is for the property agent to inform you of any houses or business premises that may be of interest to you. This contact takes place until you state that you no longer need this service. The following data may be processed:

Use of data by the sector organisation
The property agent shares certain data with the sector organisation (NVM, Vastgoedpro, etc.) via a link.
The relevant sector organisation is the controller of the data received. The sector organisation uses the data for the following purposes:
A. Ensuring that all property agents have up-to-date listings of houses and business premises that are listed via property agents.
B. Ensuring that the current listings are published on Funda and other (housing) websites.
C. Creating a database that can be used for valuations and other value assessments and to spot trends in the housing and commercial property markets.

A Current listings of houses and business premises with property agents
If you want to sell/let a house or business premises via a property agent, the following data will be shared with other property agents:
• The address of the house or business premises, the description and characteristics of the property such as the asking price, year of construction, surface area and layout, land registry data, WOZ value and photos of the property.
• The date when the property comes onto the market, the date when the property is taken off the market. Sale subject to contract, date of sale and transaction price.
These data are used by property agents for the services they provide to their customers (people looking for a house or business premises).
These data are retained for an indefinite period in connection with the database with historical listings, see under C.

B Current listings of houses and business premises on (housing) websites, including Funda
If you want to sell/let a house or business premises via a property agent, after consultation with you, data will also be published on Funda and other (housing) websites. This concerns the following data:
• The address of the house or business premises, the description and characteristics of the property such as the asking price, year of construction, surface area and layout, land registry data, WOZ value and photos of the property.
• The date when the property comes onto the market, date of sale.
With these data, your property is brought to the attention of consumers, professional parties and/or third parties who are carrying out their own searches via (housing) websites.
These data may still be visible on these websites up to one year after the date of sale or the date when a house or business premises is/are taken off the market.

C Database with historical listings
The following data of all houses and business premises that are offered for sale or rent via a property agent are recorded in the database of the relevant sector organisation:
• The address of the house or business premises, the description and characteristics of the property such as the asking price, year of construction, surface area and layout, land registry data, WOZ value and photos of the property.
• The date when the property comes onto the market, the date when the property is taken off the market. Sale subject to contract, transaction date and transaction price.
• The postcode (1234AB) and house number of the buyer’s previous (residential) address.
The aforementioned data are retained for an indefinite period.

The relevant sector organisation uses the aforementioned data to carry out analyses of the property market.
The relevant sector organisation also shares these data with selected third parties, namely:
• Valuers, for the purpose of making valuations and other value assessments.
• Validation institutes, following a specific request from a valuer, for the purpose of checking valuation reports.
• Municipalities, for the purpose of determining WOZ values.
• The Ministry of Infrastructure and Water Management, for housing market research purposes.
• Universities, for research purposes.
• Property agents in the context of providing services to their customers.
These parties only have access to data for the stated purposes and, where possible, data are only provided at an aggregated level.
